VinAudit Buyback Guarantee Terms and Conditions



1. Definitions:


a) Claimant: The person or entity that submits a Claim.

b) Client: A person who purchases the Vehicle History Report (VHR) and subsequently becomes the Claimant if they submit a claim under the VinAudit Buyback Guarantee program.

c) Branded Title: A vehicle ownership or registration document issued by any of the 50 states of the U.S. (or the District of Columbia) indicating that the vehicle was junked, salvaged, dismantled, rebuilt, reconstructed, flood damaged, fire damaged, hail damaged, bought back by its manufacturer (“Lemon Law” vehicle), odometer exceeds mechanical limits, odometer was not actual mileage, or issued with any other symbol or word signifying a substantially similar brand.

d) Excluded Brands: Specifically excluded from the definition of Branded Title are ownership and registration documents originally issued without a Brand but later stamped with a Brand without being reissued, salvage titles issued due to theft, damage disclosure documents, and Branded Titles issued in error and later corrected. Other information that may reflect negatively on the vehicle, including but not limited to accident information, is excluded from the VinAudit Buyback Guarantee unless expressly covered by the definition of “Branded Title.”

e) Claim: A request by the Claimant for compensation under the VinAudit Buyback Guarantee with respect to a Vehicle.

f) Report/VinAudit Report: The VinAudit Vehicle History Report.

g) Vehicle: The passenger vehicle or light truck to which the Report relates.

h) Terms and Conditions: These VinAudit Buyback Guarantee Terms and Conditions.

2. VinAudit Buyback Guarantee Terms and Conditions


Subject to the following, VinAudit.com, Inc. agrees to pay the Claimant the Claimant’s purchase price of the Vehicle if:

a) The VinAudit Vehicle History Report was provided prior to the purchase of the Vehicle; and

b) The VinAudit Vehicle History Report reflects no Branded Titles as part of the Vehicle Title history, but a Branded Title actually exists, and the following conditions are met:

1. The Claimant owns the Vehicle at the time the Claim is made. If the Vehicle is subject to a lien, the Claimant must contact the lienholder, obtain the payoff amount, and agree to grant VinAudit.com, Inc. or its agents possession of the Vehicle if the Claim is approved.

2. The Branded Title was issued at least thirty (30) days prior to the date the Report was run, and the Brand record exists in the NMVTIS database.

3. The Claim is submitted within one month after the date of the Report.

4. The Client must have registered explicitly for the package including “VinAudit’s Buyback Guarantee” within thirty (30) days of purchasing the Vehicle. Registration can be made online at www.VinAudit.com or by mail to: Consumer Affairs Department, VinAudit.com, Inc., Buyback Guarantee, 15117 Main St #205-853, Mill Creek, WA 98012, USA, including the name, address, telephone number, email address, VIN of the guaranteed Vehicle, and the purchase price.

5. The Claimant must complete and submit an executed and notarized Affidavit Claim Form along with a complete copy of the Report, which must have been run before the Vehicle was purchased by the Claimant.

6. The Claimant must provide to VinAudit proof of ownership of the Vehicle in the form of the original bill of sale and a current vehicle ownership document issued to the Claimant by the motor vehicle agency of one of the 50 states of the United States or the District of Columbia.

7. The Claimant must provide to VinAudit a copy of the front and back of the Branded Title, certified by the issuing state authority. The document must have been issued at least 30 days before the Report was run.

8. The Branded Title must have been reported by the motor vehicle agency into the NMVTIS database prior to the date on which NMVTIS was run.

9. The Claimant must deliver to VinAudit all ownership and registration documentation, including the certificate of title and certificate of registration, properly assigned by the Claimant to VinAudit so VinAudit becomes the owner of the Vehicle.

10. VinAudit will pay a maximum of twenty thousand dollars ($20,000) for the Vehicle, excluding warranties, insurance, and other additional purchases including aftermarket accessories, parts, and services.

11. VinAudit.com, Inc. will accept only one Claim per Vehicle Identification Number under the VinAudit Buyback Guarantee or any other VinAudit.com, Inc. certification or guarantee program.

12. The Claimant is not an employee, or a family member of an employee, of VinAudit.com, Inc. or its affiliates.

13. The VinAudit Buyback Guarantee will apply only if the Vehicle was manufactured in model year 1981 or later.

14. The VinAudit Buyback Guarantee will expire the earlier of (a) the date the Claimant sells the Vehicle or (b) thirty (30) days after the date of the first Report run by or for the Claimant relating to the Vehicle.

15. If, prior to purchasing the Vehicle, the Claimant knew or had evidence of the existence of a Branded Title for the Vehicle, the VinAudit Buyback Guarantee does not apply.

16. VinAudit reserves the right to cancel the VinAudit Buyback Guarantee program at any time, but pledges to honor all current and future VinAudit Buyback Guarantee claims as long as they meet all of the VinAudit Buyback Guarantee terms and conditions stated herein and the Report was run prior to VinAudit Buyback Guarantee program cancellation.

17. By accepting the Payment, Claimant waives and releases VinAudit.com, Inc. from all claims, actions, suits, disputes, costs, liabilities, and expenses of whatever kind Claimant may have now or in the future with respect to the Report, including but not limited to future VinAudit Vehicle History Reports for the Vehicle.

18. Claimant is responsible for the payment and discharge of all federal, state, and local taxes, if any, which may at any time be found to be due upon or as a result of the Payment.

19. Claimant will return the Payment to VinAudit.com, Inc. should VinAudit discover that Claimant provided any false or misleading information with respect to the Claim.

20. Claimant will indemnify, defend, and hold VinAudit.com, Inc. harmless against any claims, actions, damages, judgments, losses, settlements, penalties, fines, costs, and expenses (including reasonable attorneys’ fees and court costs) that may arise from (a) any false or misleading information that Claimant provided to VinAudit with respect to the Claim or (b) any person, partnership, corporation, association, insurance company, or other organization or entity claiming an interest in the Claim.

21. Claimant understands that these Terms and Conditions are binding upon and inure to the benefit of Claimant and his/her/its legal representatives, successors, and assigns.

22. If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, that decision will not invalidate or void the rest of these Terms and Conditions which will still be given full force and effect.

23. The VinAudit Buyback Guarantee will be governed by the laws of, and the Claimant consents to the exclusive jurisdiction of the courts of, the State of Delaware, United States of America.
